At Cardiff Magistrates Court Mr C J pleaded guilty to the offence of driving with no insurance, and 6 penalty points were put on his driving licence. Unfortunately, he already had 6 points on his licence and, therefore, this brought his total up to 12 penalty points. Normally, when someone has 12 penalty points or more on their driving licence they have to be, by law, disqualified for at least 6 months. However, Mr Hatvany, the leading road traffic law solicitor, then successfully argued exceptional hardship.
Outcome:
The magistrates didn’t disqualify Mr C J from driving because they found that this would cause exceptional hardship and so he was able to keep driving.
