Bath Magistrates Court

Before the trial took place at Bath Magistrates Court, the leading motoring specialist solicitor, Philip Hatvany, pointed out to the prosecutor that there was no evidence to suggest that Ms V C was speeding. Eventually the prosecutor agreed and withdrew the allegation of speeding.  This just left Ms V C facing the allegation that she had failed to respond to the written request from the police, asking her to identify who was driving at the time.  Ms V C maintained her not guilty plea to failing to identify the driver.  At the trial Mr Hatvany pointed out how Ms V C hadn’t received this request from the police because her post had failed her and, therefore, she couldn’t respond.  Mr Hatvany showed how the reason for the poor postal service was because there were so many other properties, with similar addresses to Ms V C’s, and therefore the postman must have become confused.

Outcome:

The magistrates found Ms V C not guilty of the offence of failing to identify the driver.
